Fiqh Malaysia: Ke Arah Pembinaan Fiqh Tempatan yang Terkini [Malaysian Fiqh: Towards the Construction of a Contemporary Local Fiqh]
Akademi Pengajian Islam, Universiti Malaya, Kuala Lumpur · 2000
Abstract
A collection of studies compiled by Paizah Hj. Ismail and Ridzwan Ahmad, published by the Academy of Islamic Studies (Akademi Pengajian Islam), Universiti Malaya. The book advances the idea of "Fiqh Malaysia", namely an effort to build a local (tempatan) fiqh that is responsive to the social, cultural, and economic realities and legal system of contemporary Malaysia, without detaching itself from the framework of the Shafi'i school and the principles of usul al-fiqh. The authors discuss its theoretical foundations, such as ijtihad, maslahah, maqasid al-shari'ah, and 'urf (local custom), and then apply them to current issues: muamalah and Islamic banking, family law, zakat, fatwa, the administration of Islamic law, and the relationship between sharia and civil law. The book reflects the discourse on Islamic legal reform in Malaysia in the late 1990s and is relevant to similar ideas in Indonesia, such as Indonesian fiqh and Nusantara fiqh.
