Abstract
An opinion article by Masdar Hilmy in the daily Kompas on the relationship between law enforcement and the quality of democracy, which he likens to two sides of the same coin. Referring to Guillermo O'Donnell, the author judges that law enforcement in Indonesia is still tendentious, personal, and partial, and then sets out five facts of "the banality of law": the law is sharp downwards but blunt upwards; the criminalisation of anti-corruption activists; the pretrial hearing of Budi Gunawan, which annulled his suspect status set by the KPK (Corruption Eradication Commission); the conflict of authority between the KPK and the Polri (Indonesian National Police); and talk of granting sentence remissions to corruptors. The author calls on President Joko Widodo and Vice President Jusuf Kalla to honour their commitment to upholding the law free of corruption and warns of the danger of democratic involution if the eradication of corruption weakens.
